Terms & Conditions of Participation

for offers, classes, courses, workshops, events, challenges and online memberships by Nicole Jacqueline De Virgiliis and BallaLoco®

This is a translation for your convenience. In case of any discrepancy, the German version is legally binding.

1. Scope & conclusion of contract

These General Terms and Conditions (T&C) apply to offers, classes, courses, workshops, events, challenges and online memberships by Nicole Jacqueline De Virgiliis and BallaLoco®. By registering for or booking an offer (online, in writing or verbally), a contract is concluded between the participant (hereinafter “participants”) and the organiser.

These T&C also apply to trial classes and taster offers.

By registering, you agree to the following conditions.

2. Registration & participation

Registration is binding. Participation is only guaranteed after written confirmation or successful payment.

Participation is always at your own responsibility.

3. Health requirements

The offers serve personal development, movement, self-discovery and relaxation.

They do not replace medical or psychotherapeutic treatment and do not constitute healing practice in the legal sense.

The organiser works mindfully and places great value on a safe setting. Nevertheless, physical and emotional processes may be triggered, which are experienced differently by each individual.

By registering, participants confirm that they:

  • are physically and mentally able to take part in the respective offer,
  • act on their own responsibility,
  • and inform the instructor of any relevant health restrictions before taking part.

If you have health concerns, we recommend seeking medical advice beforehand.

4. Disclaimer of liability

Participation in all offers is at your own responsibility and risk.

Participants are aware that physical activities such as dance, fitness, Pilates, stretching and similar offers may involve physical and health risks.

Participants are themselves responsible for assessing their health and physical suitability for the respective activity and for disclosing health restrictions, complaints, injuries or other relevant circumstances before taking part.

No liability is accepted for:

  • health risks or consequences arising from incomplete or incorrect information,
  • injuries, accidents or damage to health, unless caused by conduct of the organiser giving rise to liability,
  • theft, loss or damage to personal belongings,
  • damage resulting from technical faults (e.g. internet connection for online offers), to the extent permitted by law.

The organiser is liable for damage, injuries or health impairments only to the extent permitted by law. Liability for damage attributable to the participant’s personal state of health, to the self-responsible performance of exercises or to other circumstances not caused by conduct of the organiser giving rise to liability is excluded to the extent permitted by law.

Liability for damage for which liability is mandatory by law remains reserved.

For online offers, participants are responsible for a stable internet connection, a suitable environment and the technical setup.

5. Photo and video recordings

During classes, workshops or sessions, photos or short videos may occasionally be taken to capture the atmosphere of the event and use it for information or promotional purposes (e.g. website, social media, flyers).

If you have consented to the use of such recordings, they may be used without any claim to remuneration or licence fees.

If you do not wish to be photographed or recorded, please say so explicitly before the event begins.

Participants may not record, reproduce or distribute content themselves.

6. Cancellations & withdrawal

With your registration, your spot is reserved for you on a binding basis.

For BallaLoco® / dance and fitness classes / 1:1 coachings:

Cancellation is free of charge if made within the cancellation period stated for the respective offer.

If you cancel after the stated period or do not show up, the full amount will be charged.

For workshops and events, the cancellation and withdrawal conditions stated for the respective offer apply.

For events, the general rule is:

Tickets are non-refundable but can be transferred to another person if you are unable to attend, unless otherwise stated for the respective offer.

Cancellation by the organiser:

The organiser reserves the right to cancel or postpone a single class, workshop or event for important reasons (e.g. illness, too few participants or force majeure).

In this case, a replacement date or a replacement teacher/coach will be offered where possible, or the participation fee will be refunded in full.

Further claims are excluded to the extent permitted by law.

7. Online memberships & digital offers

When booking an online membership or an online workshop, you receive access to the agreed content once payment has been received.

Access is personal and non-transferable.

Sharing, recording or reproducing content is prohibited.

Payments are made in advance via the stated payment methods.

For recurring memberships, access is automatically renewed for the agreed period unless cancelled in good time.

Cancellation is possible at any time, effective at the end of the current billing period.

8. Data protection

All personal data is treated confidentially and used within the scope of applicable data protection regulations to process registrations and deliver the offers.

Data is only passed on to third parties if this is necessary to deliver the offers, required by law, or if corresponding consent has been given.

Further information can be found in the separate privacy policy.
